L’Union Europeenne dans le labyrinthe de l’avenir – problemes fondamentaux

Within the framework of the EU enlargement, especially after the Nice Summit, appeared the problem of a new structure of the future of Europe, in creating a model that would clarify the report between the European and the national identity of the Member States. The questions that have risen regarding this issue, the debates and the various solutions concern especially the way in which the national identity would be affected due to the integration process and, at the same time, whether the European Union’s identity would be affected by the admission of new member states. The necessity to reform the current community institutions, to make a new institutional framework has determined the statement of certain points of view, to present certain relevant models of different positions, both within the Member States of the European Union and among the candidate countries. By presenting the stated opinions that contain original solutions, the common points of view, and also the extremely different proposals that are in competition, this work shall try to make more visible certain conclusions on the legal side, without however neglecting certain logical considerations, particularly useful in order to understand the aspects of this theme.

Reforma instituţională: între rezultatele summit-ului de la Nisa şi misiunile conferinţei interguvernamentale

The future of the European Unions is conditioned by the evolution of the reform process which the institutions are facing up nowadays. The institutional system established more than fifty years ago had at that time a coherence dependant on the geographical, political and judicial realities, less complex than those that the Union endures nowadays. The reforms of the European institutional architecture – within the context of the steps of the enlargement process – were not substantial. Going from 15 to 25 and even 27 members requires a more profound approach, rather pragmatic, of the idea of institutional reform. The attempts of institutional reform that have marked the Amsterdam and Nice moments have represented an important contribution to the same objective of regaining the institutional coherence that should respond to the new geopolitical realities.
